2. Agreement Terms

1. **Scope of Services:**
- By using TSI software, I understand that TSI software, its partners, employees, developers, or anyone associated with TSI software is in no way responsible for any pay, payroll, transportation, or any other aspect related to my employment.
- I acknowledge that TSI software’s sole function is to match my skills with employers looking to hire.

2. **Reporting Requirements:**
- I agree to report to TSI software immediately if an employer requests that I work off of the TSI software platform and not use the app for recording my working hours. I understand that failing to report such a request may result in the suspension or cancellation of my account for breach of this term.

3. **Fee Structure:**
- TSI software will never charge me for the use of their software. The use of TSI software is 100% free of charge for me.

4. **Performance Recording:**
- I understand that my work performance, attendance, and habits will be recorded and placed on a scale of 1 to 10 for employers to see.
- I may request to review my performance score by submitting a request in writing or by email with proper identification.

5. **Experience Verification:**

  • When adding my experience to TSI software, I will only include jobs for which I can provide proof of experience.
  • I agree to upload my resume before being placed on the active list.
  • I agree that TSI software may contact any employer listed on my resume to verify my work history and qualifications.

6. **Job Acceptance and Attendance:**

  • I agree to only accept job offers for which I am qualified.
  • I agree to show up for all scheduled shifts once I have accepted a job offer.
  • I agree and acknowledge I do not now or will be working for TSI Software

**7. Permitted and NOT Permitted**

  1. I understand that doing any form of drugs that are not prescribed by a licensed doctor that I may be terminated and also removed from the TSI platform without any further notice.
  2. I also understand that drinking on the job or going to work under the influence or having alcohol on my breath, that I may be terminated at once without further notice.
  3. I also understand that all employment found through the TSI Platform is STRICTLY on a Temporary base and that this agreement will be forwarded to all employers that I accept employment from.
  4. This agreement is for temporary work which may last from a min of 3 hours or may last longer but can be terminated at any time for any reason and that I have NO recourse for wrongful dismissal or wrongful termination.
  5. I also understand that in NO way am I a part of any company including the job offer I accept and that I am NOT entitle to any company benefits during my work through this agreement.

# Temporary Placement Contract

**This Temporary Placement Contract (the "Contract") is made and entered into as of

, by and between: AS ABOVE NAMED**

**1. Position and Duties**

  1. The Employee is hereby placed in the position of Temp with DIFFERENT EMPLOYER WITHIN THE TSI NETWORK OF EMPLOYERS.
  2. The specific position, duties, and responsibilities will be agreed upon at the time of job acceptance through the TSI software for placement and recruiting.

**2. Term of Placement**

  1. The start and end dates for each assignment will be agreed upon between the Employee and the Employer using the TSI software for placement and recruiting.
  2. The term of this placement shall continue until terminated by either party in accordance with the provisions of this Contract.

**3. Compensation**

  1. The Employee shall be compensated at a rate agreed upon in digital form for each assignment before the commencement of work, as documented in the TSI software.
  2. Payment shall be made [Weekly/Bi-Weekly/Monthly] on [Day(s)] by the EMPLOYER AS PER THE AGREED TERMS WITHIN THE TSI SOFTWARE.

**4. Benefits**

  1. The Employee will not be entitled to any additional benefits such as paid time off, health insurance, or retirement plans, beyond the compensation specified in Section 3.

**5. Work Hours**

  1. The Employee’s work hours shall be as agreed upon for each assignment using the TSI software.
  2. The Employee may be required to work additional hours as necessary to fulfill the duties of the position.
  3. ALL hours will be tracked by the TSI Software and the Employees agrees to use said for all hours worked.

**6. Termination**

  1. This Contract may be terminated by either party at any time, with or without cause, without notice as this is a TEMPORARY CONTRACT ONLY.
  2. The Placement Agency reserves the right to terminate this Contract immediately, without notice, for just cause, including but not limited to gross misconduct, breach of contract, or failure to perform duties.

**7. Confidentiality**

  1. The Employee agrees to maintain the confidentiality of all proprietary information, trade secrets, and other confidential information of the Client Company and its clients.
  2. This obligation of confidentiality will survive the termination of this Contract.

**8. Transferability**

  • This Contract is transferable to any other companies within the TSI Network of Employers, provided that the Employee's duties and compensation remain substantially the same.
  • **9. Governing Law**

    1. This Contract shall be governed by and construed in accordance with the laws of the State of the Employers Home Address, without regard to its conflict of laws principles.
  • **10. Entire Agreement**

    1. This Contract constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and negotiations, whether written or oral, relating to the subject matter of this Contract.

    **11. Amendments**

    1. Any amendments or modifications to this Contract must be made in digital form and submitted through the TSI Software and also posted on the TSI website located at https://tempserviceinternational.com

    **IN WITNESS WHEREOF, the parties hereto have executed this Temporary Placement Contract as of the day and year first above written.**
